TOMOTO PRODUCT LIMITED WARANTY.

Tomoto (We, Our or Us) warrants the ATVs supplied by Us against manufacturing defects in workmanship and material for a period of six (6) months from the date of sale (Term) to the original purchaser (You or Your) as follows:
• This warranty applies only to You and is not transferable to subsequent owners.
• This warranty applies only to ATVs purchased in fully assembled original condition from Us.
• Only the following are covered:
oo Engine: internally lubricated parts, pistons & rings, crankshaft, main bearing, connecting rods, rod bearings, camshaft, camshaft bearings, timing gear & chain, valve springs & guides, oil pump, push rods, rocker arms, lifters, rocker arm shafts. Engine block, heads and cylinder barrels are covered only if damaged by a part listed in this sentence.
oo Transmission: internally lubricated parts, gears, bearings, internal drive gear & chains, internal selector mechanism; transmission case is covered only if damaged by a part listed in this sentence.
oo We specifically do not cover: tires, seats, decals, shocks, bulbs, LEDs, batteries, brakes, body panels, and anything that is partly or in whole due to overheating, abuse, ordinary wear and tear, shipping, accident, low or contaminated fluids.
• This warranty is void if the ATV is used as rental or subject to abuse, neglect, improper repair, improper maintenance, overheating, alteration, modification, accident or other abnormal, excessive, or improper use.
• Damage resulting from normal wear and tear, including the results of fatigue, is not covered. Fatigue damage is a symptom of the frame being worn out through normal use. It is one kind of normal wear and tear, and it is your responsibility to inspect your ATV.
• Damage resulting from use of parts and accessories not supplied by Us is not covered.
• All labor charges for warranty service are Your responsibility.

During the Term of this warranty, We will either repair any defective part, or, at Our option, replace any defective parts with the same or most nearly comparable part then available. THIS IS THE EXCLUSIVE REMEDY UNDER THIS WARRANTY. ANY AND ALL OTHER REMEDIES, INCLUDNG TORTS, AND DAMAGES THAT MAY OTHERWISE BE APPLICABLE ARE EXCLUDED, INCLUDING, BUT NOT LIMITED TO, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
THIS IS THE ONLY WARRANTY MADE BY US, AND THERE ARE NO WARRANTIES OR CONDITIONS WHICH EXTEND BEYOND THE DESCRIPTION IN THIS WARRANTY. ANY WARRANTY THAT MAY OTHERWISE BE IMPLIED BY LAW INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE EXCLUDED.


To obtain warranty service, You must first obtain a return authorization number from Us during the Term and then return, postage prepaid, the defective part during the Term with Your original dated sales receipt for the ATV, detail reason of defect in writing, the vin number, and the RMA number. Any returned part becomes the property of the manufacturer and will not be returned to You even if it is determined not to be covered by the warranty. If We determine the part is within the warranty and the replacement part is in stock, We will ship the replacement part to You within 10 days upon receipt of the original defective part; otherwise, it can take 30 days or more for shipment from factory in China.
This Limited Warranty gives You specific legal rights. If it is determined by a court of competent jurisdiction that a certain provision of this limited warranty does not apply, such determination does not affect any other provision of this limited warranty and all other provisions remain in effect.
